Sports betting in Taiwan operates under a highly restrictive legal framework, with only state-run sports lottery being legally permitted. The Criminal Code of the Republic of China prohibits most forms of gambling, including private sports betting operations and online wagering platforms (1). Taiwan's government maintains a monopoly through the Taiwan Sports Lottery, managed by China Trust Bank, which offers limited betting options with a legally capped payout ratio of approximately 78 percent.
Online gambling, including sports betting on foreign websites, became explicitly illegal in 2022 when Taiwan's Legislative Yuan amended Article 266 of the Criminal Code (2). This amendment closed previous legal loopholes and made gambling via telecommunications equipment, electronic devices, the internet, or similar methods a criminal offense. The maximum fine for violating these provisions was increased to TWD 50,000, reflecting the government's commitment to strengthening enforcement against unauthorized gambling activities.
"Taiwan's legislature in December amended Article 266 of the Criminal Code so that gambling 'in a public place or open to the public' applies to gambling activity on member-only websites and in other electronic forums."
Despite these strict prohibitions, enforcement challenges remain as many Taiwanese citizens continue accessing offshore betting platforms that operate outside the country's jurisdiction (1). The government-licensed sports lottery faces significant competition from illegal foreign operators who offer higher payout ratios and more diverse betting markets. While the legal framework clearly prohibits unauthorized sports betting, the practical reality involves ongoing efforts by authorities to combat illegal gambling operations and educate citizens about the legal risks associated with using unlicensed platforms.
